Foreclosure Bills - 2/29/12

HB1875 HD1 - Relating to Foreclosures. This bill would implement the recommendations of the 2011 Mortgage Foreclosure Task Force, and make substantive changes to the existing Act 48.

HB2018 HD1 - Relating to Foreclosures. This bill would address the unfair and deceptive act or practice issue, by repealing the UDAP provisions in Act 48, and then placing them back into effect after the sunset date of the mortgage foreclosure dispute resolution program that was enacted in Act 48.

HB2019 - Relating to Mortgages. This bill would prohibit deficiency judgements to recover the remaining balance on a short sale.

Foreclosures: Act 48 Revamp

SB 2429 SD1 - Relating to Foreclosures.

This bill would, among other things, repeal Part I of Chapter 667, dealing with non-judicical foreclosures, and remove the sunset from Act 48, making permanent the dispute resolution program.

Unemployment Contribution Rates

HB 2096 HD1 - Relating to Employment Security.

This bill would adjust the current unemployment contribution rate for employers.

Mortgage Loan Originators

SB 2763 SD1 - Relating to Mortgage Loan Origination.

This bill would remove the exemption for entities subsidized by federally-insured financial institutions from registering as mortgage loan originators.

Sick Leave

HB 2089 HD1 / SB 2507 - Relating to Health. Requires employees to provide a minimum amount of paid sick/safe leave for an employee to use to care for a family member who is sick, needs medical care, or is a victim of domestic violence, sexual abuse, or stalking.

Ethics

Testimony on HB 2455: Excepts members of groups formed by statute or resolution from the state code of ethics. This bill seeks to "fix" the HRS with regards to ethics and state employees, due to a recent opinion by the Hawaii State Ethics Commission that said members of the Mortgage Foreclosure Task Force are considered state employees, therefore violated ethics laws by lobbying.
